Edunities Sdn Bhd

These Terms and Conditions (Terms) govern access to, and use of the Edunities mobile application, website and related educational services (collectively known as "Service") provided by Edunities Sdn Bhd (Edunities).

By creating an account, clicking to accept, purchasing a subscription or using the Service, the user agrees to these Terms. If the user is under 18 or otherwise lacks capacity to contract, the parent or legal guardian who authorises the account agrees to these Terms on the user's behalf and is responsible for supervising use of the Service.

If you do not agree, do not create an account, purchase a subscription or use the Service.

Eligibility and child users

For this Policy, a "Child User" is a user under 18 years of age, reflecting the age of majority under the Age of Majority Act 1971, subject to any applicable statutory exception. A Child User may use the Service only with the consent and supervision of a parent or legal guardian, or through an account validly authorised by a school.

A Child User may register with a username that is not tied to the child's real name. Where an email address is needed for account recovery, privacy notices, consent or subscription administration, Edunities will request the email address of the parent or guardian, rather than the child's email address. The registration flow must identify when the user is under 18 so that these protections can be applied.

A parent or guardian who purchases or authorises a subscription for a Child User is responsible for the subscription, recurring charges and cancellation.

The Edunities Service

Edunities provide educational lessons, questions, explanations, audio, images, activities, assessments, and/or related features. Features may vary by subject, school year, device, region, subscription plan or account type.

Accounts and Security

Users must provide accurate, current and complete information, keep it updated, and select a username that does not impersonate another person, infringe rights, contain inappropriate material or expose unnecessary personal information.

Credentials are personal and must not be shared except with an authorised parent, guardian, teacher or account administrator. The account holder or supervising adult must notify admin@edunities.com promptly of suspected unauthorised use. Edunities may require a password reset, identity verification or other security measures.

Licence of Usage of the Service

Subject to these Terms, Edunities grants the user a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the Service for personal educational purposes during the applicable access period.

Unless Edunities gives written permission, the User may not copy, reproduce, publish, sell, rent, distribute, scrape, systematically download, publicly display, reverse engineer, bypass access controls, create a competing dataset or service from, or otherwise commercially exploit the Service or its content.

Educational Content and Results

The Service is a supplemental learning tool. It does not replace a school curriculum, teacher, tutor, examination authority, professional assessment or advice. Scores, progress indicators, recommendations, badges and predicted performance are informational and do not guarantee examination results, admission, certification or any other outcome.

We aim to provide useful and age-appropriate content, but educational information may contain errors, omissions or become outdated. Users, parents and teachers should exercise judgment and report suspected errors. Edunities may correct such content without any further notice when deemed to be required.

Artificial Intelligence

Edunities may use artificial intelligence (AI) to assist in drafting lessons, questions, explanations, images and other content. Content is checked and may be amended by Edunities according to its educational formula and quality requirements before publication to the Users.

User personal data and user inputs are not sent to an AI provider as part of this content-production workflow and are not used to train an AI model. AI-assisted content can still be incomplete, inaccurate or unsuitable in a particular context and should not be the sole basis for a high-impact decision.

Intellectual Property

The Service, software, design, characters, graphics, lessons, questions, explanations, audio, images, databases, trademarks and other materials are owned by or licensed to Edunities and are protected by Malaysia law.

Some materials may be owned by third parties, used under license, and/or any other lawful basis. Those rights remain with their respective owners. No ownership is transferred to the user, and no right is granted except the limited license expressly stated in these Terms.

If a copyright or other rights holder believes material in the Service infringes their rights, they may send a notice identifying the work, the challenged material and location, their contact details, the basis of the complaint and evidence of authority to admin@edunities.com. Edunities may investigate and remove or restrict access to material where appropriate.

Learning Interactions and Feedback

The Service records answers and limit learning interactions only as described in the Privacy Policy and does not currently permit users to upload, post or publicly share text, audio, images, comments or other content.

If a user voluntarily provides suggestions or feedback by email or another support channel, Edunities may use it to operate and improve the Service without payment, provided Edunities does not publicly identify the user without permission.

Privacy

Our collection and use of personal data are described in the Edunities Privacy Policy. The Privacy Policy forms part of the framework governing the Service but is not a substitute for any separate consent required by law.

Third-party Services

The Service may use, integrate with or link to app stores, payment providers, sign-in services, school systems, cloud services or external websites. Third-party terms and privacy notices may apply. Edunities is not responsible for a third party's independent service, content or conduct, except to the extent responsibility cannot be excluded by law.

Fees, Subscriptions and App-store Purchases

Paid plans, prices, billing periods, included features, applicable taxes and any trial terms will be displayed before subscription. After the initial subscription period, and after each later period, the subscription automatically renews for an equivalent period unless it is cancelled before the next renewal in accordance with the applicable app-store or payment-provider instructions. The account holder authorises recurring charges to the selected payment method.

A subscription must be cancelled through the billing channel identified at purchase, such as the relevant app-store subscription settings or Edunities account/payment settings. Deleting the app or an Edunities account does not by itself guarantee cancellation of a separately administered subscription. Unless the checkout terms state otherwise, cancellation stops the next renewal, and paid access continues until the end of the current paid period.

Except where required by applicable law or the rules of the relevant app store or payment provider, fees already paid are not refundable or prorated merely because the user stops using the Service before the end of the paid period. Nothing in these Terms limits a right or remedy that cannot lawfully be excluded, including applicable rights under the law.

Service Availability and Updates

We aim to keep the Service available but do not promise uninterrupted or error-free operation. Access may be affected by maintenance, updates, internet or device issues, third-party services, security incidents or events outside reasonable control.

The user may need to install updates to continue using the Service securely. Data charges, devices and internet access are the user's responsibility unless a separate agreement says otherwise.

Suspension and Termination

A User may stop using the Service and request account closure through the mobile application. Subscription cancellation must also be completed through the applicable billing channel. Edunities may warn, restrict, suspend or terminate access where the user materially or repeatedly breaches these Terms, creates safety or legal risk, fails to pay a valid charge, misuses the Service, or where action is reasonably necessary to protect users or the Service.

Disclaimers and Statutory Rights

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. Edunities does not promise that every item of content will be complete, current or error-free, or that the Service will always meet a user's individual learning needs.

Limitation of Liability

To the maximum extent permitted by law, Edunities will not be liable for indirect, incidental, special or consequential loss, loss of opportunity, loss of data or loss of profit arising from use of the Service, where such loss was not reasonably foreseeable or was not caused by Edunities' breach.

Subject to liabilities that cannot be excluded, Edunities' aggregate liability arising from the Service during any 12-month period will not exceed the total fees paid by the claimant to Edunities for the Service during the 12 months immediately before the event giving rise to the claim. This limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of confidentiality or data-protection duties where liability cannot lawfully be limited, or any other non-excludable liability.

Responsibility for Breach

To the extent permitted by law, any User is responsible for reasonably foreseeable loss caused by their own deliberate or negligent material breach of these Terms, unlawful content or misuse of the Service.

Changes to these Terms

Edunities may update these Terms to reflect changes in the Service, commercial arrangements, security or law. We will post the revised Terms with a new effective date. For any material change, we will provide reasonable notice and obtain renewed acceptance where required. Changes will not retrospectively remove rights already accrued.

General

These Terms, and/or feature-specific terms presented at purchase or use form the agreement regarding the Service. If a specific term conflicts with these Terms, the specific term governs only for that feature or plan.

This Privacy Policy explains how Edunities Sdn Bhd (Edunities) collects, uses, discloses, stores and protects personal data when the user uses the "Edunities" mobile application, Edunities web application and/or related educational services and/or whatsoever Services which may be regarded in the future (collectively to be known as "Service").

Applicability

This Privacy Policy shall apply to all users of the Service (Users).

Depending on the way the Service is used, Edunities collect and/or generate the following:

Where the data comes from

Edunities receive the username, email address and selected school directly during account registration, sign-in or account management from the user. Edunities automatically receive the IP address and limited sign-in and usage data when the Service is accessed. Edunities receive subscription status and transaction references from the relevant app store or payment provider.

How Edunities uses Personal Data

Edunities process personal data only for the purpose connected with operating, protecting, funding and improving the Service, including:

Children and parental or guardian involvement

Analytics

For users, Edunities may use limited analytics to measure use and advertising effectiveness and to research which subjects, school levels and content should be improved or developed. Personalised advertising will be used only where permitted and subject to applicable consent and opt-out choices. Child Users receive family-safe advertising.

The website or application may use cookies, local storage, software development kits or similar technologies needed for sign-in, security, subscriptions, analytics and advertising. Disabling a necessary technology may affect the relevant feature.

Edunities uses an IP address only to derive an approximate location and for security, subscription administration, payment processing and fraud prevention. It does not collect precise device GPS location. A school location is known only through the school selected or provided during registration or account management.

An IP address will generally be retained for no more than 30 days. If a user has a subscription, Edunities may retain the IP address for longer only where and for so long as reasonably necessary for payment processing, chargeback handling or fraud prevention, subject to applicable law.

Artificial Intelligence

Edunities may use artificial intelligence (AI) tools to help draft lessons, questions, explanations, images or other content. Edunities checks and may amend that material according to its educational contents and quality requirements before it is made available for the users.

AI tools are used in an internal content-production workflow and not to make decisions that produce legal or similarly significant effects on a user. Edunities does not send user personal data or user inputs to an AI provider as part of this workflow, and does not use such data or inputs to train an AI model.

When Edunities disclose Personal Data

Edunities may disclose personal data only as reasonably necessary to:

Transfers outside Malaysia

Some service providers may process or store personal data outside Malaysia. Where personal data is transferred across borders, Edunities will take reasonable steps to ensure an appropriate level of protection and will rely on a lawful basis and/or any applicable laws necessary in ensuring such standard of protection is provided.

Data Retention and Deletion

Edunities retain account and related personal data while an account remains active. When an account becomes inactive because it is closed, cancelled, expired or subject to a valid deletion request, Edunities will generally delete, destroy or irreversibly de-identify the personal data within 60 days.

An IP address is generally retained for no more than 30 days. For a subscription account, it may be retained longer only where and for so long as reasonably necessary for payment processing, chargeback handling or fraud prevention. Certain records may also be retained longer where required by law, or reasonably necessary to establish, exercise or defend legal claims, resolve disputes or investigate serious misuse.

Security and Data Breaches

Edunities use reasonable organisational, technical and physical measures appropriate to the nature of the data, such as access controls, authentication, encryption where appropriate, secure development practices, backups, staff confidentiality and vendor oversight. No system is completely secure, and users should protect their credentials and notify us of suspected unauthorised access.

If a personal data breach occurs, Edunities will take reasonable steps, and notify relevant authorities when require.

Fields marked as required are needed to create or operate the relevant account or feature. If required information is not provided, Edunities may be unable to create the account or provide that feature. Optional information may be withheld without losing access to unrelated functions.

Third-party Services and Links

The Service may link to or integrate with third-party services. Their privacy practices are governed by their own notices. Edunities is not responsible for a third party's independent processing but will remain responsible for its own obligations when appointing a processor or disclosing data.

Privacy Policy Updates

Edunities may update this Policy to reflect changes to the Service, our data practices or the law. Edunities will post and/or notify you by email on the revised Policy with a new effective date and provide additional notice, and seek consent, where required for a material change.
